Terms and Conditions of Sale

The Terms and Conditions of Sale apply to all transactions between the company hereby called InnoVapor, LLC and any person who places an order from InnoVapor, LLC hereby called Customer. Any person that creates an account and becomes a Customer acknowledges having read the Terms and Conditions of Sale and declares to be of the legal age of 18 before placing an order. Unless otherwise specified in writing, all transactions between InnoVapor, LLC and its Customer are determined by the Terms and Conditions of Sales described here and are accepted by the Customer.

All items available for purchase from InnoVapor, LLC are hereby called products. These products are NOT intended to diagnose, treat, cure, or prevent any mental and/or physical conditions. People should not use these products if they: 1) are under the age of 18, 2) have weak or impaired immune systems, 3) are allergic to nicotine-based products, 4) have heart conditions and/or blood-pressure problems, 5) are pregnant. InnoVapor, LLC makes no claims intended to replace the advice of your healthcare professional and advises all Customers to consult with a physician prior to using these products. These products are NOT sold for smoking cessation and as such, InnoVapor, LLC makes no claims as to the success these products may have for use as a smoking cessation device.

By purchasing these products, Customer agrees to use products at their own risk. Under no circumstances will InnoVapor, LLC be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have caused in connection with use of or reliance on any products.

Customer can order only products that InnoVapor, LLC has in stock. No backorders will be accepted. For orders of 100 units or more, please contact us at support@innovapor.com for discount pricing and availability. All orders are subject to acceptance by InnoVapor, LLC and may be refused for any reason. All orders must be paid in full prior to shipping (see payment options on order form). Orders shipping to Idaho addresses will be charged a 6% sales tax.

InnoVapor, LLC ships only via United States Postal Service with Delivery Confirmation or Federal Express. Orders of $35.00 or more receive FREE USPS First Class Mail service. InnoVapor, LLC does not charge a handling fee. Adult Signature Confirmation is available at no additional cost to Customer. Choose "YES" on the drop down menu for Adult Signature at checkout. USPS Priority and Express services are available for an additional cost. For expedited delivery requirements, InnoVapor, LLC will make any reasonable attempt to meet the Customer's delivery requirements. Orders must be placed before 12 pm to be shipped USPS Express the same day. USPS Express is overnight in most, but not all areas. FedEx Priority Overnight is also available for expedited shipping. For immediate service call 208-761-0895. InnoVapor, LLC will not be held responsible or liable for delivery issues or delivery failures, and will not be held liable for any loss the Customer may suffer as a result of late delivery or refusal of their order. InnoVapor, LLC will not be held responsible or liable for any package once the United States Postal Service or Federal Express scans it into their system. Insurance is available for an additional $2 for USPS shipping. Insurance is included with FedEx Priority Overnight shipping. InnoVapor, LLC will replace a lost or damaged package with insurance.

To insure quality, all products are inspected by InnoVapor prior to shipping. Upon receipt of package, Customer shall inspect products for order accuracy. Customer must notify InnoVapor, LLC at support@innovapor.com of any order discrepancy within 48 hours of receipt of their products. Upon notification, Customer will be contacted by InnoVapor, LLC via e-mail to make arrangements to rectify the issue.

The Alpha Main Body, Alpha Battery Sleeve, Alpha Atomizer Interface, Alpha Reservoir Expansion System, and Alpha Custom Carrying Case have a 10 year warranty against manufacturing defects. The Alpha Switch Assembly has a 3 year warranty against manufacturing defects. All Chinese made atomizers, batteries, chargers, and power adapters have a "dead on arrival" warranty meaning if the product does not function correctly when it is received by the Customer, it is subject to replacement under warranty. Customer must notify InnoVapor, LLC at support@innovapor.com of any warranty claim within 48 hours of receipt of their products. Warranty begins when we receive confirmation of delivery, given to us by the USPS delivery confirmation system. All products subject to warranty replacement must be returned to InnoVapor, LLC, PO Box 7368, Boise, ID 83707. Customer must return products subject to warranty claim in the original package and include the original packing list. Customer is advised to adequately insure package and ship with delivery confirmation. Upon inspection and approval by InnoVapor, LLC, products subject to warranty replacement will be replaced. InnoVapor, LLC will NOT warranty products damaged by the Customer. Products approved for warranty replacement will NOT be refunded. ULTRApure E-Liquid carries no warranty and cannot be returned. Pelican cases have an unconditional lifetime warranty. All sales are final.

All products on this website are consumable and will eventually need replacing after a length of time depending on usage and treatment. Estimations of product performance and duration are based on factory specifications. InnoVapor, LLC makes no claims to the actual performance and duration the Customer may experience with these products. InnoVapor, LLC offers only products we believe are of high quality. Our ultimate goal is to provide you, our Customer, with products and service to exceed your expectations.

If any term or provision of these Terms and Conditions of Sale is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions of Sale had been agreed with the invalid illegal or unenforceable provision eliminated.

InnoVapor, LLC reserves the right to modify and/or change its Terms and Conditions of Sale without notifying the Customer. InnoVapor, LLC reserves the right to adjust pricing without notifying the Customer and will honor our website pricing at the time of Customers order.

This website and intellectual property rights in its design, text, graphics, and selection and arrangement thereof, together with the logos and trade names depicted in this website belong to InnoVapor, LLC.

Typographical Errors
In the event that a InnoVapor ,LLC product is mistakenly listed at an incorrect price, InnoVapor, LLC reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. InnoVapor, LLC reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, InnoVapor LLC shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by InnoVapor, LLC without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including InnoVapor, LLC or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. When you order products through InnoVapor, LLC, we request that you provide us with certain Personal Information on our order form to allow us to process and ship your order. You must provide contact information (such as name, address, phone number, and e-mail) and financial information (such as credit card number, expiration date, and verification code). When ordering our products, you agree to provide accurate and complete Personal Information.
